I just received a preliminary report from the Fayetteville Police Department on the arrest of Arkansas linebacker Khiry Battle.
The sophomore was booked into the Washington County Jail early Sunday morning on misdemeanor charges of driving under the influence and violation of the city’s noise ordinance. He was also charged with violation of Arkansas’ implied consent law after refusing to take a breathalyzer test.
According to the report, an officer pulled over Battle shortly after midnight Saturday when he heard loud music coming from the linebacker’s car as he drove eastbound on Dickson Street.
“I approached the driver and immediately smelled an odor of intoxicants,” the report said. “I asked (Battle) if he had been drinking and he said he had not.”
The officer reported that Battle failed a field sobriety test, and after being transported to the Washington County Jail, he refused to take a breathalyzer test.
Still no word from Arkansas officials about Battle’s latest run-in with the law.
